Does anyone know about employment law ?

finding my way again !
As i have been looking into having a tummy tuck sometime in the future i just wondered if i would get sick pay or if i would have to have holiday / unpaid leave as it is cosmetic rather than "needed". i work for the NHS if this has any bearing on the answer.
thanks in advance
xx:)

Ooohh thats an interesting question. Id be interested in the answer to that, though I suspect it may vary from employer to employer - but then Im probably wrong on that lol

Hi

I'm no expert but I do know that an employer does NOT have to pay you when you're off sick - it's a benefit not a legal requirement - I guess that means (assuming your employer would usually pay you when off sick) it would be discretionary and dependent upon if they see a cosmetic procedure as illness?

in "normal" cicumstances i would get full pay for 6 months, i may have to make discrete inquires !

I'm no expert hun but i think it would be on employers discretion. It's cosmetic surgery not essential surgery so you may have to take holidays. Unless of course you can convince them it's for medical reasons??

I know someone had a TT done but just told employers she was having a stomach operation so there are ways around it....

Oh and legally, statutory sick pay is cancelled if the person leaves the country (even for a holiday), strange but true!

Hi I'm a lawyer and have done a bit of this type of work in the past but not enough to be able to say with confidence! I will check it out with a colleague who specialises in employment law and get back to you.

Sorry but the answer is no you wouldn't be entitled to sick pay as the absence would be deemed to have arisen for a reason other than sickness - although of course a "nice" employer might decide to pay it voluntarily!
